Terms of Service

Padel Vision provides automated, AI-generated analysis of padel videos. The Service:

• Processes user-submitted videos
• Generates analysis, annotations, and scores
• Provides informational feedback for technique improvement

The Service is informational only and is not professional coaching or medical advice.

You may use the Service only if:

• You are 18 years or older, or have consent from a parent/guardian
• You have the legal capacity to enter into these Terms

If your video contains minors, you must be the parent/guardian or have explicit parental consent to upload and process the footage.

3.1 Ownership

You retain full ownership of all videos and content you upload ("User Content").

3.2 License to Us

By uploading User Content, you grant Enko Group B.V. a worldwide, non-exclusive, royalty-free license to:

• Store, host, and process your videos
• Generate analysis, annotations, frames, and derived outputs
• Display the analysis to you within your account

This license is solely for operating and improving the Service.

3.3 Your Responsibilities

You confirm that:

• You have all necessary rights to upload the User Content
• All identifiable individuals in the video have given consent
• For minors, you are the parent/guardian or have explicit parental permission
• The content does not violate any laws or third-party rights

3.4 Indemnification

You agree to indemnify, defend, and hold harmless Enko Group B.V., its directors, employees, and contractors from any claims, liabilities, damages, losses, and expenses arising from your breach of these Terms or violation of third-party rights in relation to User Content you upload.

The Service uses automated AI models that may:

• Misidentify strokes or movements
• Produce incomplete or inaccurate analysis
• Provide estimates that do not reflect real skill level

We do not guarantee accuracy of any advice, annotations, metrics, scores, or recommendations.

The Service is not a substitute for professional coaching, biomechanical assessment, or medical advice. Your use of AI-generated feedback is entirely at your own risk.

5.1 Credits

Padel Vision operates on a credit-based model. Credits are consumed when an analysis starts. Once credits are used to begin an analysis, they are non-refundable.

5.2 Payments

Payments are processed by Stripe. We do not store full credit card details.

5.3 Refunds

Refunds are governed by the Refund Policy. Unused credits may be refundable within 14 days of purchase. Used credits are not refundable.

5.4 EU Withdrawal Waiver

For EU consumers, digital credits are delivered immediately. By clicking "Purchase", you agree to immediate delivery and acknowledge losing your right of withdrawal once the analysis begins.

You are responsible for maintaining the confidentiality of your login credentials and all activity under your account. Notify us immediately if you suspect unauthorized access.

Account deletion and data handling are described in the Privacy Policy.

You must use the Service in compliance with these Terms and the Acceptable Use Policy.

You may not upload content without rights or consent, upload illegal or harmful content, interfere with the Service, or attempt to reverse engineer the AI models. Violations may result in account termination.

We may add, modify, or remove features, suspend or discontinue parts of the Service, or perform maintenance causing temporary downtime. We do not guarantee uninterrupted or error-free operation.

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and accuracy of the analysis.

To the maximum extent permitted by law:

• Our total liability is limited to the amount you paid in the last 3 months or €50, whichever is lower
• We are not liable for loss of profits, data, or business
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for injuries arising from your use of AI-generated feedback

These Terms are governed by the laws of The Netherlands. Any dispute will be brought exclusively before the competent courts of Amsterdam.

To the fullest extent permitted by law, all disputes must be resolved only on an individual basis and not as part of a class, consolidated, or representative action.

We may modify these Terms from time to time. If we make material changes, we will notify you via email or in-app notice. Continuing to use the Service after changes become effective constitutes acceptance.

If any provision is held invalid, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, Refund Policy, Acceptable Use Policy, AI Disclaimer, Cookie Policy, and Imprint, form the entire agreement.
